Welcome to CustomAIze. By accessing or using our website, platform, or services, you agree to be bound by the following Terms and Conditions ("Terms"). Please read them carefully before using our services. If you do not agree with these Terms, please do not use our services.

1. Definitions

“Company”, “We”, “Us”, or “Our” refers to CustomAIze, the AI automation and software agency. “Client”, “You”, or “Your” refers to the individual or entity that uses our services. “Services” refers to all products, digital tools, automations, websites, chatbots, workflows, consultations, and subscriptions offered by CustomAIze.

2. Scope of Services

CustomAIze provides AI-based automation services, including but not limited to:

• CRM & marketing automation

• Website & funnel building

• Workflow design & chatbot integration

• Custom AI toolkits and consulting

• Training and support

Any specific deliverables will be outlined in your individual Service Agreement or Proposal.

3. Client Responsibilities

Clients agree to:

• Provide accurate and timely information necessary for project delivery

• Use the services only for lawful purposes

• Maintain the confidentiality of login credentials and account access

• Review and approve deliverables in a timely manner

4. Payment Terms

All fees are due according to the payment schedule provided in your Proposal or Invoice. CustomAIze reserves the right to pause or terminate services for non-payment. Subscription services will auto-renew monthly unless canceled with at least 7 days’ notice.

5. Intellectual Property

CustomAIze retains ownership of all proprietary tools, frameworks, and code developed prior to the project. Upon full payment, the client will own all custom deliverables created specifically for them unless otherwise agreed in writing. You may not resell, replicate, or redistribute any part of our proprietary systems without written permission.

6. Confidentiality

Both parties agree to maintain confidentiality of any non-public, sensitive business or personal information exchanged during the project.

7. Warranties & Disclaimers

CustomAIze makes no guarantees regarding increased revenue, customer retention, or specific business outcomes. Services are provided “as is,” and we disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose. We are not responsible for third-party service outages (e.g. GoHighLevel, OpenAI, Twilio, etc.)

8. Limitation of Liability

To the maximum extent permitted by law, CustomAIze shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the total amount paid by you for the services in the 3 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate services at any time due to:

Breach of these Terms, Non-payment, Misuse of our services.

You may cancel ongoing services with written notice, in accordance with your service agreement.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be resolved in the courts located in Apeldoorn, Netherlands.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page, and your continued use of our services constitutes your acceptance of the revised terms.
